Stole a cell phone but did not like it and returned it
The young man returned it because he disliked.
A young man snatched the mobile phone to a woman in the street and, after observing the model, gave it back because "he did not like." The man was acquitted by the Criminal Chamber of Buenos Aires, which held that voluntarily desisted from crime.
In a resolution signed the maid Maria Laura Garrigues Rebori, Rodolfo López Pociello Argerich and Mirta Gonzalez is "specifically mentioning that the formation of this (criminal case) in no way affects the good name and honor to enjoy" the accused.

Facts of the case occurred when the boy proceeded to return the phone "already possessed" the victim "stating that he did not like, to turn around and say nothing, and then continue his way."
The judges explained that the assailant "freely decided not to seize the stolen item and do not consummate the harmful action, even though it was capable of finding, especially when the victim did not resist at all."
In that sense, should apply, the judges said the two facets of its ruling. Article 43 of the Penal Code which states that "the author's attempt will not be subject to punishment when voluntarily desist from crime."
The judges explained that this withdrawal should be "unconditional special action based on any part of the system of punishment or coercion of a third party", as argued by lawyers Eugenio Zaffaroni, Alejandro and Alejandro Slokar Alagia in his treatise on criminal law.
